How to Prevent Nursing Home Malpractice

By: Art Gib

It's hard to watch your parents or other loved one grow old and need outside help and care. When you make the tough decision to put them into a nursing home, you want to make sure you have they have the best care available. To prevent the need to hire a nursing home abuse attorney, it is important to carefully select a quality home and continue to take preventive precautions while your family member is there.

Finding a Good Nursing Home

1. Get referrals from friends, neighbors, family members and coworkers.

2. Before formally visiting, quietly visit and watch what takes place. Watch how the patients are treated when no one is looking. Notice the friendliness of the front staff and nursing staff. Pay attention to tiny details that competency.

3. Formally visit the nursing home and ask for a tour of the facility.

4. Go prepared with a list of detailed questions. Ask open-ended questions rather than yes or no questions.

5. Ask for references you can call. Again, when you talk to the references, make your questions specific. Ask questions such as:

* What activities do they have?
* Did your family member seem happy?
* Did you ever hear of anyone pursuing a malpractice suit with this facility?
* What was your access to the patient's charts and records?
* Etc.

6. Call the Better Business Bureau and any nursing home associations to check if there have been complaints and how they were resolved.

Ongoing Preventive Precautions

Once you have found the care facility that you want to use, it is important to continue to monitor the care your loved one is receiving.

1. After the initial adjustment period is over, one of the best indicators of good care is how they feel about being there. If they are happy and satisfied, it tells you a lot about their care. When you visit them, listen to their complaints. Investigate the complaints for validity with an open mind and seek to remedy the situation if needed.

2. Monitor their health care records. Ask to look at their medical charts. Get copies to keep in your files. You can even hire a company who understands what the charts and records mean. They will analyze them and give you a medical chart review.

3. Remember, you are their best, and sometimes only advocate, for the care they receive. If the staff knows that they will be watched and followed-up on, then your loved one will rise to their attention above others.
